Rights and obligations of adoptive parents

The adoption of the adoptive child becomes effective when the adoption contract is approved by the court. As a result of the approval, the rights and obligations of the biological parents are transferred to the adoptive parents. Such rights and obligations shall relate to

  • he caring for and bringing up of the child,
  • legal representation, and
  • administration of assets, as well as
  • the obligation to provide maintenance.

If the adoptive child is adopted by only one adoptive mother/father, the relations between the child and the biological mother/father and his/her relatives under family law, such as those pertaining to the care and upbringing of the child, cease to exist.

However, the relations between the biological parent and the child under family law continue to exist if the child is adopted by the same-sex partner of that parent.
